论家庭暴力案件中高度盖然性证明标准的实现

Research on the Realization of High Degree of Probability in Domestic Violence Cases

由于家庭暴力发生环境的法律特征和暴力行为受害人的弱势地位,以往的证明规则难以达到高度盖然性的证明标准,负面影响了家庭暴力事实的认定,阻碍了受害人获得司法救济。在暴力循环理论的基础上,立法吸收表见证明规则的实现方式,将家庭暴力受害人的举证责任转变为对暴力历史这种经验事实的列举,适时地增加证据种类和证据收集主体,推动法官自由心证的形成,是受害人及时获得民事救济的重要方式。

Because of the legal characteristics of the environment in which domestic violence occurs and the vulnerable status of the victims of violent acts,the previous rules of proof are difficult to achieve the high degree of probability,which negatively affects the identification of domestic violence facts and hinders the victims’access to judicial relief.On the basis of the theory of the cycle of violence,the legislative absorption table shows the way to realize the rule of proof,transforms the burden of proof of the victims of domestic violence into the enumeration of the empirical facts of the history of violence,and increases the types of evidence and the main body of evidence collection.
