上海建设全球著名体育城市语境下体育法治建设的探索

On the Development of Sports Law in the Context of Building Shanghai into a World Famous Sports City

上海市人民政府于2020年10月17日制定了《上海全球著名体育城市建设纲要》,提出在2025年基本建成全球著名体育城市。本文运用文献资料法、调查法,认为在上海建设全球著名体育城市时,法治不能缺位,并从体育法规体系、法治实施体系、法治监督体系、法治保障体系4个子系统分析了当下上海在建设全球著名体育城市过程中体育法治建设现状,指出目前所面临的主要挑战是政府职能转变,以及体育市场监管和营商环境的优化。从完善体育法规、建立体育执法协调机制、推进政府体育职能转变、激发体育社会组织活力、建立体育纠纷解决机构、培养高素质法治人才、健全反兴奋剂制度、宣扬体育法治文化八方面提出建议,为上海体育发展出谋划策,以期加快实现建设全球著名体育城市的目标。

In November 2020,Shanghai municipal government issued the Outline for the Construction of Shanghai World Famous Sports City,proposing to build Shanghai into a world famous sports city by 2025.By reviewing literature and investigation,this paper holds that the rule of law during the construction of a world famous sports city cannot be absent.Based on the four subsystems,namely,sports law system,legal implementation system,legal supervision system and legal guarantee system,this paper analyzes the current situation of sports law construction in the process of building Shanghai into a world famous sports city.It is pointed out that the main challenges at present are the transformation of government functions,the supervision of sports market and optimization of business environment.Some suggestions are put forward based on the following eight aspects:improving sports laws and regulations,establishing sports law enforcement coordination mechanism,promoting the transformation of government sports functions,stimulating the vitality of social sports organizations,establishing sports dispute settlement institutions,cultivating high-quality legal talents,improving anti-doping system,and promoting sports legal culture,so as to provide reference for the development of Shanghai sports and accelerate the realization of the goal of building a world famous sports city.
