专利制度下中药复方保护问题的思考——以防治新冠肺炎药方为例

Reflections on the protection of Chinese Herbal Compound under patent system——Take prescriptions for COVID-19

中医药是中华民族的瑰宝,为中华民族乃至世界人民生命健康做出了巨大贡献,特别在此次疫情中发挥出重要的作用。在印发的诊疗方案中提出中医治疗取得了良好的效果,并被国外一些疫情严重的国家学习,这使得中医药再次进入我们的视野。虽然中医药的地位逐渐提高,但我们仍看到与之相关的保护存在一些问题。知识产权保护是理论和实践中比较有力的一种保护,特别是其中的专利制度,不仅可以保护权利而且可以防止滥用。但是从中医药的特点与保护现状来看,在作为中医药核心的处方仍然存在保护不足之处,需要从防止新冠肺炎的药方出发分析这些不足并提出解决路径。

TCM is the treasure of the Chinese nation,and has made great contributions to the life and health of the Chinese nation and even the people around the world.In particular,it played an important role in this epidemic.TCM treatment was put forward in the published diagnosis and treatment plan,which achieved good results and was learned by some foreign countries with severe epidemic.This brings TCM into our field of vision again.Although the status of TCM is gradually improving,we still find some problems in its related protection,which arouses our thinking.The protection of intellectual property rights is a relatively strong theory and practice of a kind of protection,especially the patent system,not only can protect the rights,but to prevent abuse.But from medical current situation,characteristics and protection as a core of TCM prescription still exist to prevent deficiency.This paper was intended to prevent COVID-19 according to the prescription of these deficiencies and do their own thinking.
