小浪底水利枢纽运行期招标合同管理风险管控实践 被引量:3

摘要 招标采购与合同管理过程中的各种风险管控是小浪底水利枢纽运行投资管理的重点和难点,结合小浪底水利枢纽运行期间的管理实践,分析了招标采购与合同管理中的廉政风险、法律风险、管理风险等风险因素。根据对各风险因素的分析,小浪底管理中心采取明确职责分工、强化权力运行约束、规范招标采购方式和主体、规范招标采购文件编制和审查、规范投标文件评审、严格合同管理、建立实时信息报告制度、强化责任追究等措施,并建立了招标采购与合同管理风险防控体系,以降低各种风险发生的概率。提出小浪底管理中心应强化招标采购标准范本的应用、合理设置合同双方权利和义务、严格合同分包管理、确保涉及农民工及中小企业的合同款支付等措施。 Procurement and contract management are important contents of investment management of Xiaolangdi Hydro⁃Junction Project in the operation period.This paper analyzed the risk factors of honest government,law risk and management risk in bidding procurement and contract management based on the management practice of Xiaolangdi Dam.Based on the analysis of risk factors,the Xiaolangdi Dam Man⁃agement Center has adopted such measures as clarifying the division of responsibilities,strengthening the constraints on the operation of pow⁃er,standardizing the methods and subjects of tender procurement,standardizing the compilation and examination of tender procurement docu⁃ments,standardizing the evaluation of tender documents,strictly managing contracts,establishing a real⁃time information reporting system and strengthening accountability,the risk prevention and control system of bidding procurement and contract management was established to reduce the probability of various risks,suggestions like reinforcing the applied bidding and procurement standards,rationally setting the rights and obligations of both contract parties,conducting strict sub⁃contract management and guaranteeing the contract payment involved with labors and SMEs were proposed.
