摘要
《中华人民共和国公职人员政务处分法》为新时代做好政务处分工作提供了制度遵循。政务处分在制度理念上的创新主要包括监督全覆盖、“两个责任”协同推进、注重宽严相济等。政务处分运作模式上的创新主要体现为:在立法模式上实现了程序法与实体法的有机统一;在处分类型上实现了普遍性与特殊性的有机统一;在运作形态上实现了党纪与国法的有机统一;在对公职人员的要求上实现了约束权力与保障权利的有机统一。为了更深入地贯彻《政务处分法》,需要界定政务处分对象的边界,优化政务处分的运作机制以及制定相关的配套法规体系。
The Law of the People’s Republic of China on Administrative Sanctions for Public Officials provides a system to follow for the administrative sanctions in the new era.The innovations of administrative sanctions in the systematic conception mainly include full coverage of supervision,coordinated advancement of“two responsibilities”,and emphasis on both leniency and strictness.The innovations in the operational mode of administrative sanctions is mainly reflected in:the organic unity of procedural law and substantive law in the legislative mode;the organic unity of universality and particularity in the type of disciplinary action;the organic unity of party discipline and state law in the operational form;the organic unity of restraining power and guaranteeing rights in the requirements of public officials.In order to implement the Law more deeply,it is necessary to define the boundaries of administrative sanctions,optimize the operational mechanism of administrative sanctions,and formulate related supporting legal systems.
