党内法规与国家法律衔接协调的内在机理与现实路径 被引量:12

摘要 党内法规与国家法律的结构耦合是法治中国建设的必然。就目前而言,党规国法的衔接协调还不够充分,需要进一步强化二者的耦合。基于习近平法治思想中提出的法治对破解社会发展问题具有重要依托作用的论述,应当从“党内法治”视角思考党规国法衔接协调的路径,即在强化党章结构耦合机制的基础上实现党规自我优化,并通过完善党内法规制度体系和构建党内法规备案审查联动机制促进党规的自我发展、自我审查,以更好实现党规国法的衔接协调。 The structural coupling between inner-Party rules&regulations and national laws is indispensable in the development of law-based governance in China.At present,the cohesion and coordination of the Party rules&regulations and the national laws are not yet adequately realized,so it is necessary to further strengthen the coupling between the two.Based on the argument of Xi Jinping’s thought on the rule of law that the rule of law plays an important supporting role in solving the problem of social development,we should think about the path of linking and coordinating the Party rules&regulations and the national laws from the perspective of“inner-Party rule of law”,that is,to realize the self-optimization of the Party rules and regulations on the basis of strengthening the coupling mechanism of the Party constitution structure and to promote the self-development and self-examination of the Party rules and regulations by perfecting the system of inner-Party law&regulations and constructing the linkage mechanism of inner-Party law filing and examination,so as to better realize the cohesion and coordination of the Party rules&regulations and the national laws.
