民法典视野下国际货物买卖中的所有权转移问题

The issue of ownership transfer in international goods sales from the perspective of civil code

全球化时代的来临让商品交易不再局限于国内市场,国际货物买卖已经日益成为各国开展贸易最普遍的方式。国际货物买卖并没有同国内货物买卖从根本上割裂开来,二者本质上都是通过交易出让或取得物的所有权。由于国际货物买卖过程中涉及不同国家对金融、保险、交通运输等不同领域的规定,加之买卖合同的标的比之国内买卖更大,因此其风险具有更大的不确定性。其中,所有权取得与风险移转作为直接涉及买卖双方切身利益的核心问题,其重要程度不言自明。

With the advent of the era of globalization,commodity trading is no longer confined to the domestic market.International commodity trading has increasingly become the most common way for countries to conduct trade.The international sale of goods is not fundamentally separated from the domestic sale of goods.Both are essentially through transactions or acquisition of property ownership.Since the process of international goods sales involves the regulations of different countries in different fields such as finance,insurance,and transportation,and the subject matter of the sales contract is larger than that of domestic sales,the risks are more uncertain.Among them,ownership acquisition and risk transfer are the core issues that directly involve the vital interests of buyers and sellers,and their importance is self-evident.
