“犯罪人属性情节”在缓刑适用困境辨析

Analysis on the Predicament of"Criminal Attribute Circumstance"in Probation Application

缓刑、假释等非监禁的适用是我国轻刑化刑事政策的组成部分。在目前积极的刑事立法主义的语境下,在量刑中设计监禁刑和非监禁刑选择在实践中体现为对缓刑的适用上,犯罪人的属性情节除了某些特殊的规定,并未有司法机关在裁量是否能适用缓刑的的法定条件,随社区矫正法的颁布以及社区矫正社区影响评估对法院是否给以缓刑也只是参考的作用。以犯罪人的属性情节,将量刑的考量与缓刑的实际执行串联在一起,考量刑罚的预防刑的需要,作为刑之减免情节,真正实现缓刑制度的功能,也有利于社区矫正制度的发展。

The application of probation,parole and other non-imprisonment is a part of China's criminal policy of light punishment.In the context of current positive of criminal legislation,the design of imprisonment in the sentencing non-durance penalty selection in practice and embodied on the application of the probation,the attribute of criminal plot in addition to some special provisions,does not have the judicial organsin discretion whether can apply probation of the statutory conditions,along with the promulgation of the community correction method and the community impact assessment on whether the court to community correction probation is only a reference.According to the attribute circumstance of the offender,the consideration of punishment and the actual execution of probation are linked together,and the need of penalty prevention is considered.As the circumstance of remission of punishment,the function of probation system is realized and the development of community correction system is also facilitated.
