摘要
研讨会主要聚焦于新就业形态下的劳动群体与工会工作,尤其是新就业形态下劳动者群体的权益维护困境与对策。与会者在探讨劳动关系和工作模式新变化的基础上,指出新就业形态下劳动者群体的权益维护困境主要源于劳动者“弱从属、无保障”的现状、缺少有针对性的法律规制、互联网技术对劳动者维权行为的抑制作用;并从以单独立法模式建立“弱从属、弱保障”劳动关系、修改和完善相关法律规制、灵活适用现行法律、加强工会组建维权工作等方面提出了对策建议。
The seminar mainly focused on the labor groups and trade union work under the new employment form,especially the difficulties and Countermeasures of protecting the rights and interests of the labor groups under the new employment form.On the basis of discussing the new changes of labor relations and working mode,the participants pointed out that the dilemma of safeguarding the rights and interests of workers in the new employment pattern mainly stems from the status quo of“weak subordination and no security”of workers,the lack of targeted legal regulations,and the inhibitory effect of Internet technology on workers’rights safeguarding behavior;and from the establishment of“weak subordination and weak security”labor system with a separate legislative mode This paper puts forward some countermeasures and suggestions,such as improving the relationship between trade unions,amending and perfecting the relevant laws and regulations,applying the existing laws flexibly,and strengthening the work of trade union organization and rights protection.
