论“行规”对民族餐饮业营商环境法治化之影响

On the Influence of“Industry Associations Rules”on the Legalization of the Business Environment of the Minzu Catering Industry

在民族餐饮业中存在着大量的“行规”,其中部分“行规”具有鲜明的民族特色和地方特色。随着各民族外出务工,将部分“行规”适用于营业所在地,因而产生了劳务输出地“行规”与输入地“行规”不一致及不同省市间“行规”冲突的情形。对此,应根据现有法律法规和《优化营商环境条例》的相关规定,坚持市场化、法治化原则,对弥补法律之不足的“行规”予以认可,对明显违背公平竞争原则和扰乱市场经济秩序的“行规”予以取缔,对部分经营者强行推行“行规”的行为加以制裁,以期能发挥“行规”的自律功能,从而实现少数民族餐饮业营商环境法治化,以及政府治理和社会调节的良性互动。

There are a large number of“Industry Associations Rules”in the Minzu catering industry,some of which have distinct Minzu and local characteristics.As all Minzu groups go out to work,some of the“Industry Associations Rules”are applied to the place of business,which has resulted in inconsistencies between the“Industry Associations Rules”of the labor exporting place and the“Industry Associations Rules”of the importing place and conflicts of the“Industry Associations Rules”between different provinces and cities.In this regard,in accordance with the existing laws and regulations and the relevant provisions of the“Regulation on Optimizing the Business Environment”,adhere to the principles of marketization,rule of law.To recognize the“Industry Associations Rules”that make up for the deficiencies of the law,and deal with obvious violations of the principle of fair competition and disrupting the market.The“Industry Associations Rules”of the economic order will be outlawed,and some operators should be sanctioned for the forced implementation of“Industry Associations Rules”.The self-discipline function of“Industry Associations Rules”will be exerted,so as to realize Minzu Catering Industry business environment under the rule of law,and the positive interaction between government and social adjustment.
