文化权益保障视域下全民阅读立法的问题与对策研究

Research on the Problems and Countermeasures of Nationwide Reading Legislation from the Perspective of Cultural Rights and Interests Protection

文章以党的十九届四中全会提出的“健全人民文化权益保障制度”的内涵精神为参照,揭示当前全民阅读立法中存在着立法目的庞杂、阅读权中心地位不凸显、政府义务泛化、阅读权益缺乏平等保护和原则性条款多、社会力量参与难以落实等不足,并提出从建构以公民阅读权利保护为中心的立法体系、健全政府阅读权平等保障义务与责任规定、加强社会力量参与全民阅读的制度安排等方面进一步完善全民阅读立法的建议。

Taking the connotation spirit of“perfecting the system of safeguarding people’s cultural rights and interests”put forward by the the Fourth Plenary Session of the 19th Central Committee of the Communist Party of China as a reference,the paper reveals that there exits shortcomings in the current nationwide reading legislation,such as the numerous and complicated legislative purposes,low centrality of the right to read,generalization of government obligations,lack of equal protection of the right to read,numerous provisions in principle,and difficulty in implementing the participation of social forces.Then,the paper puts forward the suggestions to further improve the nationwide reading legislation from the aspects of constructing a legislative system centered on the protection of peoples’reading rights and interests,perfecting the government’s obligation and responsibility of equal protection of reading rights,and strengthening the institutional arrangements for social forces to participate in nationwide reading.
