摘要
在我国的现实背景下,对于那些已经登记了抵押权的一般动产而言,也依旧面临着两重困境:一是我国未建立起统一的动产抵押登记公示机构,使得受让人想要查询受让物之上所负的负担显得十分困难;二是并非所有的动产都有登记簿等能够载明抵押权存在的凭证。这就使得现实中受让人可以信赖占有抵押物的抵押人权利的完整性,而不必再理会除此之外公示的效力。公示效力的不足无疑会让现实交易中抵押权成为交易暗礁的可能性增大。
Under the realistic background of China,those general movables that have registered the mortgage,are still faced with two difficulties.One is that China has not established a unified movables mortgage registration public announcement organization,which makes it very difficult for the transferee to inquire about the burden on the transferee.The second point is that it is not all movable property has register to wait to be able to carry the proof that hypothec exists.This makes the assignee in reality able to rely on the integrity of the mortgagor's rights in possession of the mortgaged property,regardless of the validity of the publicity beyond that.The lack of effectiveness of publicity will undoubtedly increase the possibility that mortgage becomes a transaction reef in real transactions.
