新时代加强党内法规制度体系建设探析

On Strengthening the Construction of the Institutional System of Intra-Party Regulations in the New Era

中共党内法规制度体系包括党内法规和党内规范性文件两个重要组成部分。中共中央十分重视党内法规制度体系建设,取得了很多显著成就,不仅实现了党内法规制度体系的全面发展,形成了“1+4”的基本框架结构,明确扩大了党内规范性文件的备案审查范围,而且在党内法规的运行、党内法规制度与国家法律的衔接等方面都产生了积极影响。党内法规制度体系的现存问题主要有:党内法规还存在不完备、不协调、不规范现象;党内规范性文件既缺乏区分,又缺乏形式规制。进一步完善党内法规制度体系,不仅需要以政治建设为统领、做好顶层设计、增强党内法规制度的执行力,提升治理效能,还需要以现存问题为着力点,采取有针对性的具体措施。

The institutional system of intra-party regulations includes two important parts:the intra-party regulations and the intra-party normative documents.The Party Central Committee attaches great importance to the construction of the institutional system of intra-party regulations and has made a lot of remarkable achievements.These achievements are reflected in the following aspects:the institutional system of intra-party regulations has achieved overall development and formed the“1+4”basic framework structure;the scope of filing and review of intra-party normative documents has been significantly expanded;the operation of intra-party regulations has been more standardized and effectively guaranteed;the connection between institutional system of intra-party regulations and national laws is more and more close.However,there are still some problems in the content and form of institutional system of intra-party regulations.These problems mainly include:the intra-party regulations are still incomplete,uncoordinated and nonstandard;the intra-party normative documents are lack of distinction and formal regulation.In order to further improve the institutional system of intra-party regulations,we should not only take political construction as the guidance,do a good job in top-level design,strengthen the implementation of the intra-party regulations and normative documents,and improve the governance efficiency,but also take specific measures to focus on problems.
