论幼儿教师惩戒教育的“度”:惩戒权的界限与启示 被引量:1

摘要 教师,尤其是幼儿教师惩戒权立法缺失、法律界限模糊、惩戒程度把握不当等问题备受关注。教师惩戒权来源于国家公权力,又作为教师的职业权利,在没有详细的立法细则、完善的惩戒程序和匹配的监督申诉机制的情况下,教师教育儿童就很容易造成惩戒过度,侵犯儿童的合法权益。因此,有效防止惩戒权越界是关键,保障惩戒权正确实施的重点是明确法律边界。 It attracts much attention that there are so many problems such as lack of legislation on discipline power,obscure conscious on legal boundaries and misunderstanding on discipline degree for teachers,especially for kindergarten teachers.The discipline power of teachers comes from the public power of the state,and as the professional right of teachers,in the absence of detailed legislative rules,perfect discipline procedures and matching supervision and appeal mechanism,it is easy for teachers to cause excessive discipline and violate the legitimate rights in education.Therefore,it is the key to effectively prevent the phenomenon of transgression on discipline power.and the key to ensuring the correct implementation of the disciplinary power is to clarify the legal boundary.
