人民调解制度的困境与应对

The Eilemma and Countermeasures of the People’s Mediation System

基层社会治理离不开人民调解。维护和谐稳定的社会环境,将社会矛盾化解于萌芽之中是人民调解的意义所在。人民调解制度的运用,减少了人力物力的耗费,有效防止了小纠纷演化为大矛盾甚至刑事案件。如今矛盾冲突日益复杂多样,纠纷主体呈现多元化趋势,使得人民调解制度既有积极的一面,同时也显现出其固有的弊端。在概述人民调解模式的基础上,分析人民调解制度的困境,并提出相应的对策。

Grass-roots social governance can not be separated from people’s mediation.With the increasing complexity and diversity of conflicts and the trend of multi-subjects in disputes,the People’s mediation system not only has its positive side,but also shows its inherent disadvantages.On the basis of summarizing the mode of people’s mediation,this paper analyzes the dilemma of people’s mediation system and puts forward corresponding countermeasures.
