电子数据取证“不损坏原件”原则的挑战与变通

Challenge and Adaptation of the Principle of“No Damage to the Original”in Electronic Data Forensics

信息技术的发展对电子数据取证的技术和原则提出了挑战,严格遵守“不损坏原件”原则以保证电子数据的原始性、真实性和完整性已不能满足现行电子数据取证的要求。电子数据取证应当允许对数据原件进行“有限损害”,对损害过程进行忠实记录,并对单条电子数据进行完整性评判,方可满足现行电子数据取证的实际需求。此外,电子数据取证应当走出技术绝对性的局限,通过电子数据印证、引入电子数据辅助证据以及专家辅助人等方法,将技术措施与法律制度有效结合,以应对新技术带来的挑战。

The development of information technologyhas posed a challenge to the technology and principles of electronic data forensics,and strict compliance with the principle of“no damage to the original”to ensure the originality,authenticity and integrity of electronic data can no longer meet the current requirements of electronic data forensics.Electronic data forensics should allow“limited damage”to the original data,faithfully record the damage process,and evaluate the integrity of a single electronic data,so as to meet the actual needs of current electronic data forensics.In addition,electronic data forensics should get rid of the limitation of technical absoluteness,and effectively combine technical measures with legal system by means of electronic data verification,introduction of electronic data auxiliary evidence and expert assistant,so as to meet the challenges brought by new technology.
