“通知-移除”规则在电商领域的新发展——以《涉电商平台知识产权案件审理指南》为中心的考察

New Development of the"Notice and Takedown"Rule in the Field of E-commerce:A Survey Focuses on the"Guidelines for the Trial of Intellectual Property Cases Involving E-commerce Platforms"

浙江省高级人民法院民三庭发布的《涉电商平台知识产权案件审理指南》,为"通知-移除"规则在电商领域的适用作出了新突破。该指南的"通知-移除"规则共有11条,包括"投诉渠道""对通知与反通知的要求"和"电商平台经营者对通知和反通知的处理及必要措施"三大部分,其中主要亮点有:提高涉及专利侵权通知的门槛、明确电商平台的"信使"角色定位和"形式审查+明显不合格排除"审查标准、引入保证金机制作为多元化必要措施、要求电商平台承担不合格通知的反馈义务等。文章以审查指南的内容为中心,结合电子商务的特征及实际情况,探讨"通知-移除"制度在中国司法上的新发展。

The"Guidelines for the Trial of Intellectual Property Cases Involving E-commerce Platforms"issued by the Third Civil Division of High people’s Court of Zhejiang has made a new breakthrough in the application of the"notice and takedown"rule in the field of e-commerce.There are eleven"notice and takedown"rules in the trial guidelines,including"complaint channels","requirements for notifications and counter-notifications"and"e-commerce platform operators’handling of notifications and counter-notifications and necessary measures".Most of them,the main highlights are as follows:raising the threshold for notifications involving patent infringement,clarifying the role of the e-commerce platform as a"messenger"and the review standard of"formal examination add clear non-conformity exclusion",introducing a margin mechanism as a necessary measure for diversification,requesting e-commerce The business platform undertakes the obligation of feedback of non-conformity notifications.This article focuses on the content of the review guidelines,combined with the characteristics and actual conditions of e-commerce,to discuss the new development of the"notice and takedown"system of Chinese justice.
