摘要
打拐工作集专业性、社会性二重特征于一身。目前我国以公安机关为主体的打拐司法体系遵循刑法主导的思维模式,具有“解而不治”的特点,在事前、事中、事后专业司法社会工作都缺位,导致未成年受害人及其家庭极易陷入各种混乱,引发社会不安定事件。应当以立法建构起完整的制度框架,将专业司法社会工作置于打拐工作的必要环节,形成强制干预制度,确保司法社会工作参与其中,实现对未成年人保护成效最大化。
Anti-trafficking is characterized by its professional and social features.At present,China’s anti-trafficking law system mainly based on public security bureau follows the thinking mode of criminal law,and has the characteristics of“solution but not cure”,legal social work omits in pre-event,on-event and post-event,which extremely easily lead to minors and their families to fall into all sorts of chaos and which even trigger social unrest.A complete system framework should be constructed through legislation,professional judicial social work should be placed in the necessary link of anti-trafficking work,and a compulsory intervention system should be formed to ensure the participation of judicial social work and maximize the protection effect on minors.
