中国民间文学艺术知识产权保护研究述评及展望

A Summary of Research on Intellectual Property Protection of Chinese Folk Literature

民间文学艺术面临着资源流失、盗用等保护不力的困境,民间文学艺术知识产权保护尚未得到国际社会的广泛认可。我国作为民间文学艺术资源大国,在立法保护方面仍然处于相对滞后的状态,因而对于民间文学艺术知识产权保护的研究具有重要的现实意义。但是,目前在民间文学艺术的保护主体、客体、保护期限以及保护模式等方面的研究存在较大争议。本文通过梳理学界观点,了解学者们在民间文学艺术保护研究方面重点关注的问题,发现研究存在的不足之处,以期为民间文学艺术的学术研究、法律实践提供参考。

Due to the dilemma of resource loss and misappropriation,the research on intellectual property protection of folklore in China is of great significance.At present,the research is controversial in the protection subject,object,protection period and protection mode of folklore.By combing these viewpoints,we will understand the issues that scholars pay attention to in the protection research of folklore and find out the shortcomings of the research,in order to provide reference for the improvement of intellectual property protection of folklore in China.
