高考冒名顶替受害人学籍恢复的制度与实践分析——以陈春秀高考被冒名顶替事件为对象 被引量:4

摘要 近年来多起高等教育受教育权侵权事件曝光,高等教育受教育权的保护受到社会各界的广泛关注。但由于当前我国法治发展所处的阶段特征,因此尚未对高等教育受教育权的保护进行明确具有可操作性的明文规定。面对这一现状,文章以陈春秀高考冒名顶替事件为例,从高等教育的法治发展与高等教育的治理现代化的角度,分析高等教育受教育权的本质是平等,且高等学校学生的学籍是高等学校学生享受高等教育受教育权的身份基础,这一身份的真假、存废均直接影响受教育权的公平实现。要想维护高等教育受教育权平等的实质,必须用法治思维和法治方式推动学籍恢复的制度空间与实践路径。 Recently,as the cases of infringement of the right to higher education grow,great attention of wider public has been aroused on the protection of the right.However,due to the characteristics of the current stage of the development of the rule of law in China,there are no clear and operable provisions on the protection of the right to higher education.In the face of this situation,illustrated by the example of the identity theft case of Chen Chunxiu and from the perspective of the development of rule of law and modernization of governance of higher education,this paper argues that the essence of the right to higher education is equality.Enrollment status of college students is the basis of their identities to enjoy the right to higher education.Its authenticity,preservation or abolition has a direct relation to the realization of equality.In order to protect this essence,related departments have to utilize the thinking&method of rule of law to promote institutional space and practice approaches for the restoration of enrollment status.
