民法典:社会主义核心价值观融入法治建设的典范

Civil Code:An Example of Integrating Core Values of Socialism into the Law Construction

《中华人民共和国民法典》表决通过前后,法学界对于民法典的出台倾注了较多的关注,研究成果丰硕。文章分析了在民法典立法目的中明确社会主义核心价值观的重要性和必要性,并对比了民法典中平等、公平、诚信的基本原则与社会主义核心价值观中平等、公正、诚信的区别。实践中,既要避免将社会主义核心价值观广博的内容替代法律,又要避免将民法典中社会主义核心价值观简单等同于道德要求而束之高阁。

Before and after the adoption of the Civil Code of the People′s Republic of China,the legal community has paid more attention to the introduction of the civil code,with fruitful research results.This paper analyzes the importance and necessity of clarifying the socialism core values in the legislative purpose of the civil code,and compares the differences between the basic principles of equality,fairness and faith in the civil code and in the socialism core values.In practice,it is necessary not only to replace the extensive content of socialism core values with laws,but also to avoid shelving the socialism core values in the civil code simply as moral requirements.
