Summary of Chinese Literature on the Study of Commercial Arbitration in 2019

基于对2019年收录于各中文数据库、国家图书馆以及纸质期刊上的商事仲裁中文类研究文献的整理,本综述梳理和归纳了2019年中文类商事仲裁研究的主要内容和基本特点。2019年商事仲裁中文类研究文献在数量上较去年有所增长;研究内容主要集中于仲裁协议、仲裁程序、司法监督与审查、涉外仲裁裁决的承认与执行、"一带一路"与自贸区仲裁以及特殊领域的仲裁等事项,其中国际投资领域的仲裁问题仍然是一大热点。而随着"一带一路"倡议的推进,对此背景下商事仲裁问题的研究也保持着较高热度。专家们在继续探讨我国仲裁制度中传统研究板块的相关事项的同时,还聚焦于国内外实践中涌现的新的法律现象及立法动态,对相关问题进行深挖剖析,形成众多创新理论成果,为我国仲裁制度进一步完善提供经验借鉴和学理支持。

Based on the collation of Chinese research documents on commercial arbitration in 2019 collected in various Chinese databases,the National Library and several paper periodicals,this research summary has covered and highlighted their main content and basic characteristics.Overall,the number of the aforementioned research documents exceeds that of last year.In terms of research field,2019 has seen a concentrated study on arbitration agreement,arbitral procedure,judicial review of arbitration,recognition and enforcement of foreign arbitral awards,International commercial arbitration in the context of One Belt And One Road,free trade zone arbitration and arbitration in special areas,among which the international investment arbitration is still a hot topic.With the promotion of One Belt And One Road initiative,the commercial arbitration issues under this background have also maintained a high degree of heat.While continuing to discuss the relevant issues in the traditional research section of Chinese arbitration system,scholars and experts also focus on the new legal phenomena and the latest legislative developments emerging in practice at home and abroad,carrying out in-depth analysis of the relevant issues,forming a number of innovative theoretical achievements,which provides experience and theoretical basis for the improvement of Chinese arbitration system.
