Summary of English Literature on the Study of Arbitration and Dispute Resolution in China in 2019

本文是对2019年发表的23篇关于中国仲裁和争议解决问题的英文文献的综述。根据文献内容,笔者将其归为以下主题:我国仲裁发展概况、临时仲裁在我国的发展、仲裁程序与实践问题、仲裁裁决司法审查、"一带一路"与仲裁、投资仲裁的发展、港台地区的仲裁发展等。通过对文献内容的概括和评述,笔者希望向中文读者展示英文语境下关于我国仲裁的讨论现状,尤其是通过不同作者的视角展现其中的热点问题,也希望能够增进中外仲裁从业者和学界的沟通。

This article summarises and comments on 23 journal articles and book chapters published in English in the year of 2019 focusing on the topic of China’s arbitration and dispute resolution practice.In accordance with the contents of the journal articles and book chapters,the author of this article divides them into the following themes:the overview of the developments of the Chinese arbitration;the development of ad hoc arbitration in China;the issues relevant to arbitration practices and procedure;the judicial review of arbitral awards;the‘Belt and Road’Initiative and arbitration;the developments of investor-state arbitration;the developments of arbitration in Hong Kong and Taiwan.By providing the summaries and commentaries,the author of this article aims to illustrate the discussion on Chinese arbitration in the contemporary literature in English,to approach the hot topics from the different perspectives provided by the original authors,and to encourage the communication between the Chinese and foreign scholars and practitioners.
