社区矫正中政府购买服务的风险及防范

On Risks of Government Purchasing Service in Community Correctionand Its Prevention

"购买服务"是社会力量参与社区矫正的一种方式,是一种组织化的参与径路。购买社区矫正服务对我国社区矫正实践的意义在于:弥补国家投入的不足;将社区矫正服务的提供和生产相分离,使矫正机构可以真正成为服务质量的监督者和负责人;推动全国社区矫正服务标准化;促进社区矫正平衡发展问题的解决。当然,购买社区矫正服务也存在腐败、过度市场化、供给匮乏和监督不力等风险,应当通过制度进行防范。为此应当对承接社区矫正服务的社会组织主体资格进行限制,为社区矫正服务的"市场化"划定界限,构建矫正机构固有核心职能的"负面清单"制度,积极弥补"市场化"缺陷。

"Purchasing services"is a way for social forces to participate in community corrections and an organized way of participation. The significance of purchasing community corrections services for the practice of community corrections in China is to make up for the lack of state investment,separate the provision of community corrections services from production,so that community corrections institution can truly become the supervisors and persons in charge of service quality,and standardize the national community corrections services as well as promote the settlement of the problem of balanced development of community corrections. Of course,there are such risks as corruption,ethics,excessive marketization,lack of supply and ineffective supervision in purchasing community correction services,which should be prevented through the system. So,it is necessary to restrict the qualifications of social organizations that undertake community corrections services,delimit the "marketization"of community corrections services,build a "negative list" system for the inherent core functions of correction institutions,and actively compensate for the "marketization"defects.
