Discussion on the legal attributes of administrative reconsideration decisions

行政复议决定是行政复议制度的核心问题之一。从统一的行政复议制度构建到现如今一直争议不断的法律属性,专家学者试图从不同方面论证行政复议决定是行政行为、司法行为、准司法行为等法律属性,但是并没有达成共识,进而影响到与行政复议相关制度之间的协调统一性。以我国当前的法律体系为根本,通过对行政复议决定构成要件中行政复议决定的目的、行政复议权的权力属性和行政复议程序的属性进行规范分析,行政复议决定应该是行政行为的一种类型。从行政诉讼法对行政复议决定的相关规定来看,具体细化到受案范围、被告资格、审查内容和判决结果4个方面,尽管在某些制度设计上把行政复议决定是否改变原行政行为进行区别对待,但是总体上来看依旧是把行政复议决定作为行政行为来设置相关制度的。

The administrative reconsideration decision is one of the core issues of the administrative reconsideration system.From the establishment of the unified administrative reconsideration system to the present,its legal attributes have been controversial.Different experts and scholars have demonstrated from different aspects that administrative review decisions are legal attributes such as administrative actions,judicial actions,and quasi-judicial actions,which have further affected the coordination and unification of the systems related to administrative review decisions.Based on China’s current legal system,through the standard analysis of the purpose of administrative review decisions,the attributes of the power of administrative review,and the attributes of administrative review procedures,administrative review decisions should be a type of administrative action.Judging from the relevant provisions of the Administrative Procedure Law on administrative reconsideration decisions,it is specifically detailed into the scope of the case,the qualifications of the defendant,the content of the review and the result of the judgment.Treat them differently,but on the whole,the administrative reconsideration decision is still used as an administrative act to set up related systems.
