摘要
民间艺术是中华文明智慧的结晶,历经千百年能够传承至今,除了其根植于民族民间而具有的强大生命力以外,其演绎者的作用不可忽视,他们通过改编、整理、注释、翻译等方式推动了民间艺术的传播和发展。当前,随着经济社会的发展,民间艺术潜在的文化、商业价值逐渐显现,随之而来的是对民间艺术的演绎作品日益增多,民间艺术演绎作品著作权纠纷时有发生。司法实践中界定民间艺术与民间艺术演绎作品的概念对确定演绎者是否享有著作权以及确定当事人诉讼主体资格重要意义。民间艺术演绎作品权利人拥有著作权人的诸项权利,演绎者享有署名权、修改权、发表权等;与此同时,基于民间艺术演绎作品的特殊性,为保护民间艺术的纯洁性及有序传播与发展,应该对演绎者转让演绎作品、作品境外交易进行必要的限制,并要求演绎者负有保密义务。
Folk art is the crystallization of the wisdom of Chinese civilization.The reason why it can be passed on for thousands of years,the role of performers can not be ignored in addition to its strong vitality rooted in the national folk.They promoted the spread and development of folk art through adaptation,collation,annotation,translation and so on.At present,with the development of social economy,the potential cultural and commercial value of folk art gradually appears,followed by the increasing number of folklore performing works.Copyright disputes of folk art performing works occur from time to time.The definition of folk art and folk art performing works in judicial practice is of great significance to determine whether the performer enjoys copyright and the litigant’s subject qualification.The obligee of folk art performance works enjoys all rights of copyright.Performers enjoy the right of authorship,modification and publication and so on.At the same time,the government should make necessary restrictions on the transfer of performers,foreign transactions,and require performers to have confidentiality obligations based on the particularity of folk art performance works.As a result,the purity of folk art can be protected,and folklore performing works can also be spread and developed in an orderly manner.
