论东北地区营商环境制度供给意识与制度需求的断裂与弥合

A Study on the Rupture and Closure of the Consciousness of Institutional Supply and Demand of Business Environment in Northeast China

制度供给意识与制度需求之间存在内生性的理论联系,制度供给意识与制度需求的断裂是影响制度产生法律效果的重要原因。在东北地区营商环境的相关法律制度文件中,存在制度供给意识与制度需求断裂的问题,表现为滞后性、形式化与工具化、公信力不足的问题。究其原因,是由于东北地区市场经济发育缓慢、人情文化阻力、社会力量不足等造成的,需要积极推进理性意识的转型、规范权力运行、优化市场格局,并从社会整体着手,软化东北地区制度供给意识的"外壳",实现内部观念的法治转型,以弥合制度供给意识与制度需求间的断裂。

here is an endogenous theoretical connection between the institutional supply consciousness and the institutional demand.The rupture of the institutional supply consciousness and the institutional demand is the important reason that affects the legal effect of the system.In the relevant institutional documents of the business environment in Northeast China,there are some problems such as the gap between the consciousness of institutional supply and the demand of institution,which is characterized by the lag,formalization and instrumentalization,and the lack of credibility.The reason is due to the slow development of market economy,the resistance of human sentiment culture,and the lack of social forces in Northeast China.It is necessary to actively promote the transformation of rational consciousness,standardize the operation of power,optimize the market pattern,and start from the whole society to soften the"shell"of the consciousness of institutional supply in Northeast China,realize the transformation of internal concept by law,and bridge the the gap between institutional supply consciousness and institutional demand.
