我国新型金融犯罪惩治与防范研究

新型金融犯罪衍生于金融业的创新,金融技术的升级和金融信息的不对称,是我国金融犯罪类型的最新演化形式,是金融风险的剧烈表现形式,其潜在危害巨大。惩治和防范新型金融犯罪,对维护国家金融安全具有重要意义。我国现有的刑事规制体系难以有效惩治和防范新型金融犯罪,应当积极完善金融法律体系建设,为打击新型金融犯罪提供法律制度保障;强化金融领域的市场监管,净化金融市场发展生态;加强行政执法和刑事司法衔接,提高监管和惩治效果;重点整治个别领域的突出犯罪行为,消除其负面外溢影响。此外,还应加强宣传教育、协同监管、司法教育和引导等防范对策。

The new types of financial crimes are derived from the innovation of the financial industry,the upgrading of financial technology and the asymmetry of financial information.It is the latest evolution of the types of financial crimes in China.It is a severe manifestation of financial risks and its potential harm is huge.Punishing and preventing new financial crimes is of great significance to safeguard national financial security.China’s existing criminal regulatory system is difficult to effectively punish and prevent new financial crimes.We should actively improve the construction of the financial legal system to provide legal system guarantees for combating new financial crimes,strengthen market supervision in the new financial field and purify the development of new financial markets,strengthen administrative law enforcement and criminal justice to improve the effectiveness of supervision and punishment and focus on rectifying outstanding criminal acts in individual areas and eliminate their negative spillover effects.In addition,preventive measures such as publicity and education,coordinated supervision,judicial education and guidance should be strengthened.
