根据十九大报告提出的依法治国要求,《行政复议法》已经到了要修改的阶段。完善复议制度、真正发挥行政复议的独特优势是这次修法的重中之重。再结合日韩两国的制度改革经验对我们的借鉴意义和山东、浙江两省在机构深化改革背景下的实践探索和成效,未来的《行政复议法》要以法律条文的形式规定集中行使复议权;设置独立的行政复议机关、专业的行政复议人员,以及完善的复议信息公开制度来更好地适应法治社会的发展。
