论《成人》政治思想中的黄老学派特征

Discussion on the Characteristics of Huang-Lao School in the Political Thought of Chengren

《清华大学藏战国竹简(玖)》中公布的《成人》是一篇论述国家法律法治等问题的文献,其中蕴含了重德、明刑、因循应时等思想。有学者提出《成人》思想"兼收儒法",但我们认为,《成人》中的"德"同儒家所说的"德"有所差异,"刑"亦与商鞅、韩非等法家学者的刑术不尽相同,反而一定程度上反映了战国时期黄老学派的一些特征,这也能够体现出战国时期诸子学术的融合之势。

The Chengren published in The Bamboo Slips of the Warring States Period in Tsinghua University(9)is a document that discusses issues such as the country’s law and rule of law,which contains thoughts of valuing morality,clarifying punishment,and following the times.Some scholars have proposed that the idea of Chengren contains both Confucianism and Legalism,but we believe that the morality in Chengren is different from the morality of Confucianism,and the punishment is also different from the punishment of Legalists such as Shang Yang and Han Fei.To a certain extent,Chengren reflects some of the characteristics of the Huang-Lao School during the Warring States Period,which can also reflects the tendency of academic integration of the scholars during the Warring States Period.
