论我国报复社会型犯罪及其预防

On the Revenge-on-Society Crimes and Its Prevention in China

近年来,报复社会型犯罪频频发生,给社会造成了极大危害。通过对实际发生的犯罪案例的分析和思考,发现这类犯罪有独特的原因。从社会方面来看,社会排斥和纠纷解决机制运行不良是此类犯罪发生的社会原因;从个人方面来看,认知因素和人格因素的缺陷是此类犯罪发生的个人原因。由于此类犯罪人多数悲观厌世甚至抱有与被害人同归于尽的想法,事后的惩罚对此类行为人的震慑、约束效果不佳,所以进行事前预防就显得尤为重要。

The revenge-on-society crimes refer to the murder,arson and other crimes against the society-committed by the perpetrator in order to vent his inner discontent or hatred.In recent years,the frequent occurrence of such crimes has caused great harm to society,which needs to be carefully studied.This study shows that this kind of crime has some prominent characteristics.From the point of view of the subject of crime,the perpetrators are mainly men between 26 and 55 years old.Most of them are unemployed or peasants,and their degree of education is low.About one fifth of them have criminal records.From the point of view of behavior,homicide and arson are the two most important ways of such crimes.Judging from the place of crime,the vast majority of such crimes occur in public places.Judging from the harmful results,most of these crimes endanger public safety.In addition,casualties and property losses are also common harmful results.Through the analysis and theoretical thinking of the actual crime cases,it is found that there are unique reasons for this kind of crime.From the social point of view,social exclusion and poor operation of dispute resolution mechanism are the social reasons for such crimes.From the personal point of view,the defects of cognitive factors and personality factors are the personal reasons for the occurrence of such crimes.Because most of these criminals are pessimistic and even have the idea of ending up with the victim,the afterwards punishment is not effective in deterring and restraining such actors,so it is particularly important to prevent them beforehand.Pre-prevention needs to pay attention to two aspects:first,building a comprehensive social support system;second,strengthening security work.
