The Legal Recognition and Legalization of killing with Righteous Indignation

义愤杀人作为故意杀人的特殊形态,在国外许多刑法典和我国台湾地区的刑事立法中,都规定了区别于普通故意杀人的法定刑。由于我国没有将义愤杀人情形列入刑法条文,也未通过立法解释明确义愤杀人的概念与认定要件,以至于在司法实践中,存在着对"义愤杀人"的认定情形过于宽泛、"义愤杀人"与其他相似情形的界限不清晰等问题。这就有必要对"义愤杀人"的概念从诱因、主观意志、时间、行为对象方面进行界定,严格把握其构成要件,正确区分义愤杀人与激情杀人等相似情形,并在此基础上通过"刑法修正案+立法解释"的路径使义愤杀人情节正式法定化。

As a special form of intentional homicide,indignant homicide is different from ordinary intentional homicide in many foreign criminal codes and criminal legislation in Taiwan.Because our country has not included the situation of killing with righteous indignation in the criminal law,nor through the legislative interpretation to clarify the concept and elements of killing with righteous indignation,there are some problems in judicial practice,such as the recognition of"killing with righteous indignation"is too broad,and the boundary between"killing with righteous indignation"and other similar situations is not clear.Therefore,it is necessary to define the concept of"indignant homicide"from the aspects of inducement,subjective will,time and behavior object,strictly grasp its constituent elements,correctly distinguish the similar situations of indignant homicide and passionate homicide,and on this basis,legalize the circumstances of indignant homicide through the path of"criminal law amendment+legislative interpretation".
