我国宅基地使用权退出路径研究--基于宅基地三权分置的权利构架分析

Research on the Exit Path of Homestead Use Right in China--An Analysis of the right Framework Based on the Separation of Three Rights in Homestead

在我国宅基地所有权和宅基地使用权分离的权利框架下,宅基地所有权和其他物的所有权涵义并不完全一致,宅基地所有权有着强烈的行政管理的色彩。但鉴于私法侧重于规范宅基地使用权,宅基地三权分置应当在"所有权——使用权"两权分离的基础上进行权利构架改造,使得资格权和使用权紧密联系,确保资格权保障农户的生存;资格权和使用权的相对独立,为宅基地使用权退出消除身份属性不能转移的忧虑。应当明显增强宅基地使用权的财产属性,通过出租、转让、退回集体等多元途径实现宅基地使用权的退出。

Under the right framework of the separation of homestead ownership and homestead use right in our country,the meaning of homestead ownership is not completely the same as that of other things,and homestead ownership has a strong administrative color.In addition,in view of the fact that the private law focuses on standardizing the right to the use of homestead,the separation of rights of homestead should be reformed on the basis of the separation of"ownership-right to use",so as to make the qualification right and the right to use be closely linked,and it ensures that the qualification right can ensure the survival of farmers,while the relative independence of qualification right and use right eliminates the worry that the identity attribute can not be transferred for the withdrawal of the right to the use of homestead.Promote the property attribute of the right to the use of homestead to be obviously enhanced,and realize the withdrawal of the right to the use of homestead through multiple ways such as lease,transfer,return to the collective and so on.
