专利代理可以帮助专利权人更好地进行专利运营、实现专利价值。2019年3月1日,新修订的《专利代理条例》正式实施后,其出台的众多新规将对该行业未来的发展产生巨大影响。在实证分析和规范分析的视角下,分析《专利代理条例》修订的现实原因和修订成果可知,《专利代理条例》针对专利代理行业现实中所存在的问题积极做出回应,但是,个别条文的解释和适用仍然存在隐忧,尤其是关于行业组织和惩戒规则的规定仍需要进一步明晰,以便更好地助力专利代理行业的发展。

Patent agency can help the patentee to operate the patent better and realize the patent value.On March 1,2019,after the newly revised Patent Agency Regulation is officially implemented,many new regulations will have a huge impact on the future development of the industry.From the perspective of empirical analysis and normative analysis,this paper analyzes the practical reasons and results of the revision of the Patent Agency Regulation.It can be seen that the Patent Agency Regulation actively responds to the problems existing in the reality of the patent agency industry.However,there are still hidden worries about the interpretation and application of individual provisions,especially the provisions on industry organizations and disciplinary rules in order to better help the development of patent agency industry.
