地理标志是具有显著区域性特色的品牌,对其进行科学的命名十分重要,但由于地理标志名称中包含的元素具有法定性或行业性,往往不允许单独使用,所以,地理标志通用名称判定具有特殊性。地理标志保护过程中通用名称判定对相关产业的发展以及生产经营者和消费者的利益有着重要影响,应该征询其意见。目前,我国地理标志保护过程中通用名称判定实践存在着法律和法规不统一、国内和国外相关规定外衔接不连贯,甚至存在比较激烈的冲突,严重影响着我国地理标志保护的发展与国际合作。地理标志通用名称判定在区域性范围选择上,应该以一国全境为标准,避免采用特定区域标准,进而名正言顺地实现地理标志保护的国内外协调,促进高质量发展。

The geographical indications have been the object of intellectual property protection in the Civil Code of the People's Republic of China.The agreement between the government of PRC and the European Union on geographical indications has been signed,which means that the protection of geographical indications in China will be strengthened and internationalized.The geographical indication is a brand with significant regional characteristics,and it is important to name it scientifically.In the process of geographical indication protection,the determination of common name on geographical indication is vital,as it has great impact on the development of related industries,and the interests of producers and consumers.However,there are some problems in this aspect in China,such as inconsistent laws and regulations,incoherent connection between domestic and foreign countries,which have seriously affected the domestic protection and international cooperation of geographical indications.In the selection of the regional scope of the common name of geographical indications,the entire territory of a country should be used as the standard,avoiding the use of specific regional standards,so as to justify the realization of domestic and foreign coordination of geographical indication protection and promote the high-quality development.
