环境执法风险评估制度研究

Study on Risk Assessment System of Environmental Law Enforcement

环境问题都是社会的关注热点,不同的利益主体对于生态环境的建设都有着不可忽视的责任。在这个过程中,政府起着调节、控制和管理的重要作用。但是公权力在环境执法的过程中不可避免的会产生摩擦与碰撞,因此构建一个完善的合理的环境执法风险评估制度十分必要。在进行环境执法风险评估制度基础性分析之后,总结了我国目前在制度构建过程中存在的一些问题,为我国环境执法风险评估制度的构建提出了一些中肯的措施建议,为之后的研究提供新的思路。

For a long time,environmental issues are the focus of social concern,different stakeholders have a responsibility for the construction of ecological environment.In this process,the government plays an important role in regulation,control and management.However,public power will inevitably produce friction and collision in the process of environmental law enforcement,so it is necessary to build a sound and reasonable environmental law enforcement risk assessment system.In this paper,after the basic analysis of environmental law enforcement risk assessment system,some problems existing in the process of system construction in China were summarized,and some corresponding measures and suggestions were put forward,in order to provide new ideas for the construction of environmental law enforcement risk assessment system in China.
