“Identifying Truth among Voices”——The Essence and Misunderstanding of“Legal Orientalism”

在人类法律发展浩瀚的历史长河中,法律文化植根于民族特定的社会经济土壤,或一枝独秀,或万紫千红。随着东西方经济交流的日益频繁,东西方法律文化也相互渗透和影响。一个国家的法律文化特色有其自成一格的内在逻辑,是民族精神的载体,所以人类社会的法律文化才会如此五彩缤纷。新时代的到来,中国哲学社会科学的繁荣兴盛出现崭新局面,中国特色、中国风格、中国气派的学科、学术和话语体系逐步健全,中国的国际话语权不断增强。西方学者提出的所谓“法律东方主义”愈发引人深思。它的本质是“西方中心论”下傲慢与偏见的产物,是对中国特色社会主义法治进程与规律的误读,亦是毫无根据的结论。高举马克思法学思想伟大旗帜,才能在这些纷杂的声音中甄别真理,积极构建中国特色的法律文化体系,为实现我国建成社会主义法治国家的宏伟目标奠定坚实基础。

In the long course of human’s legal development history,legal culture is firmly rooted in the particular national social-economic environment which sometimes goes for prosperity or sometimes declines just as flowers bloom or fade.Legal cultures between the East and the West have become interpenetrative and interactional along with increasingly frequent economic interaction.The feature of one country’s legal culture is based on its internal logic and deems to be the carrier of national spirit so that it has contributed to the colorful diversities of human’s legal cultures.In the new era,China’s philosophy and social science are thriving and systems of subjects,academics and discourses which display Chinese characteristic,Chinese power and Chinese style are more sound so that internationally enhanced right of speech are attached.We should ponder over so-called“Legal Orientalism”put forward by some western scholars.The essence of it refers to the result of pride and prejudice under“West Centrism”which is definitely the misunderstanding about the legal modernization of China’s socialism and also ungrounded arbitrary conclusion.Only under the guidance of Marx’s legal thoughts,can we identify the“truth”among voices and construct the legal cultural system with distinct Chinese characteristics which can lay the solid foundation of splendid goal for China’s modernization of legal system.
