契约文书所见清中期秦安县的土地、房产交易——以六件秦安县新见契约文书为中心

Land and Real Estate Transactions in Qin’an County in the mid-Qing Dynasty as Seen in Contract Documents——Focusing on Six New Contract Documents of Qin’an County

该文对甘肃省秦安县陇城镇六件新见契约文书进行了整理。这批契文的成文时间集中于清中期,跨越乾隆、嘉庆、道光三朝,均为田地、房产买卖契约。这些契文对交易产业的来源、出售原因,土地、房产买卖中的宗法关系等交易要素都有所反映。同时,从契文中看,在清代秦安县的田地、房产交易中还存在买方向卖方支付画字钱、舍业钱等礼银,以及双方利用退约逃避契税等民间交易习俗。

This thesis sorts out six new contract documents in Longcheng Town,Qin’an County,Gansu Province.The writing time of this batch of deeds was concentrated in the mid-Qing Dynasty,spanning the Qianlong,Jiaqing,and Daoguang period,and they were all fields and real estate sales contracts.These deeds reflect the source of the trading industry,the reasons for the sale,and the clan relations in land and real estate transactions.At the same time,judging from the deed texts,in the field and real estate transactions in Qin’an County in the Qing Dynasty,there were also folk transaction customs such as the buyer paying the seller money for paintings and retreats,and the two sides using the refund contract to evade deed tax.
