我国农地信托的法律障碍及完善进路——以新《农村土地承包法》为背景

Legal Obstacles and Improvement Ways of Agricultural Land Trust under the New Rural Land Contract Law in China

2018年修改通过的《中华人民共和国农村土地承包法》的落地实施为农地信托的进一步发展提供了新的历史机遇。然而,当前我国法律对其农地信托中的当事人资格、受托人激励机制以及监督体系的规定却在一定程度上阻碍了农地信托的发展。对此,应借鉴美国和日本等国的相关先进经验,通过进一步明确当事人资格、完善受托人激励机制以及构建全方位监督格局,扫清当前法律障碍,促使农地信托更好地发挥其作用。

The implementation of the Rural Land Contracting Law of the People's Republic of China,which was revised in 2018,provides a new historical opportunity for the further development of agricultural land trusts.However,the qualifications of the parties in the farmland trust,the incentive mechanism of the trustee and the supervision system in the current laws have hindered the development of the farmland trust to a certain extent.In this regard,we should learn from the relevant advanced experience of the United States and Japan to further clarify the current legal obstacles so that the agricultural land trust can better play its role.
