我国宪法解释观的原初形成及后续影响

The Original Formation and Subsequent Influence of the Concept of Constitutional Interpretation in China

法律文本需要解释才能明晰其规、内涵,才能不断适应经济社会的发展。目前,我国宪法解释在实践层面的适用处于不活跃状态,回溯其中的历史缘由可以从我国“五四宪法”制定过程中得到启示。“五四宪法”起草讨论的各个阶段对宪法解释的权限、内涵、适用情形等问题都曾提出过讨论,基于种种顾虑宪法解释问题最终被搁置。时至今日,初始的宪法解释观依然影响了宪法解释实践的积极推进,有必要谨慎选择宪法解释的实践突破口。

The legal text needs to be explained in order to clarify its rules and connotation,and to constantly adapt to the development of economic society.At present,the application of constitutional interpretation in practice is not active in China.Looking back at the historical reasons,we can get enlightenment from the formulation of the Constitution of 1954,because at all stages of the drafting and discussion of the Constitution of 1954,issues such as the authority,connotation,and application of the constitutional interpretation were discussed,and the issue of constitutional interpretation was eventually shelved based on various concerns.Today,the initial concept of constitutional interpretation still affects the positive promotion of the practice of constitutional interpretation,so it is necessary to choose the practical breakthrough of constitutional interpretation carefully.
