A Preliminary Exploration of Elements of Stimulating Competition Policy Effectiveness in the New Period

在落实十九届五中全会精神、建设高标准市场体系过程中,有必要打造完善的审查机制,通过反不正当竞争以及反垄断的执法而保障竞争的公平性,并确保市场监管的有效性,这是实现平等准入、公正监管,形成高效规范、公平竞争的国内统一市场的重要抓手。需要确保政策环境、竞争主体和竞争行为的平等性合规性,实现机会和程序的公开公平公正,具体做法包括:针对拥有公权力的行政机关和具有公共事务管理职能的组织出台的政策法规规范进行公平竞争审查;对具有国有或集体性质的企业进行竞争中立改革;对违反竞争正当性的经济社会行为进行不正当竞争惩戒。

To establish perfect investigation mechanism,to ensure the equality of competition by repressing unfair competition and execution of Anti-Monopoly Law and to make market supervision effective are substantial in the course of practicing the spirit of fifth plenary session of the 19th Central Committee of the Communist Party of China and establishing high-standard market system,which is the key to realize equal market access,fair regulation and to establish a domestic unified market that is effective,normative,and fair-competitive.This requires ensuring equal compliance with the policy environment,competition subjects and competition practices,and achieving openness and fairness of opportunities and procedures.It is needed to conduct fair competition review of the regulatory norms issued by administrative organs and organizations with public affairs management functions,promote the reform of competitive neutrality of state-owned enterprises,and punish unfair competition for economic and social acts that violate the legitimacy of competition.
