摘要
本文探析了妨害传染病防治行为之刑法规制的特殊性,并检视美国及中国妨害传染病防治罪的法律,提出妨害传染病防治罪之理论的完善建议。
This paper discusses the particularity of the criminal regulation of the act of impairing infectious dis⁃ease prevention and treatment,reviews the laws on the crime of impairing infectious disease prevention and treat⁃ment in the United States and China,and puts forward some suggestions on perfecting the theory of the crime of pim⁃pairing infectious disease prevention and treatment.
