金翼之家的法律纠纷:看corporation在不同文化模式与场域中的运作

The Legal Disputes of the“Golden Wings People”:An Analysis of the Operation of Corporation in Different Cultural Modes and Fields

过往,以Maurice Freedman为核心的中外学者使用corporation概念来观察中国东南的宗族,将其视作一个合作共财团体或法人共财团体。这对于讨论中国父系继嗣群体自有其学术价值,但是仅仅指出所研究对象是这样一种性质的社会群体是远远不够的,必须在认识上有所深化,即应进一步去探究这类合作共财团体随着不同亲属关系和国家—社会场域的变动而发生的实质性变动,从而获得一种动态的认识思路,而非过往静态的认定和研究态度。20世纪金翼黄家的两场财产纠纷案,为理解不同情境下的corporation的聚与裂提供了可能。同时,本研究试图通过跨文化的比较,解读出中国地方社会富有特色的宗族运转模式。

In the past,Chinese and foreign scholars with Maurice Freedman as their core used the concept of corporation to observe the Southern Chinese lineage,and regarded it as a cooperative co-financing group or corporate community.This has its own academic value for discussing the Chinese paternal group,but it is not enough to point out the nature of the social groups studied.We must deepen our understanding,which should further explore the changes in the operation of this kind of cooperative and public finance groups with the changes of different kinship relationships or nation-society field,so as to obtain a dynamic understanding,rather than the static identification and research orientation in the past.In the 20th century,the two property disputes of“Golden Wings people”provide us with the possibility to understand the convergence and splitting of corporation in different situations.At the same time,we try to interpret the characteristic operation mode of Chinese lineage society through cross-cultural comparison.
