我国化妆品标准及其效力研究

On Cosmetic Standards and the Effectiveness in China

目的:系统分析我国化妆品标准现状,为进一步加强化妆品标准体系建设提供参考,为探索不同实施效力的化妆品标准间相互协调,以适应我国化妆品安全生产、经营、监管提供思路。方法:从化妆品定义出发,分析现有法规与标准之间、标准与标准之间的关系,对标准在实施过程中产生的问题进行剖析。结果与结论:现有的化妆品标准之间存在对同一事项规定不一致的情形,化妆品标准体系存在不完善、不统一等问题。建议适时开展对化妆品标准的梳理工作,对化妆品标准之间存在冲突、矛盾的事项进行修订,对已不适用的化妆品标准进行修订或废止,明确化妆品标准在实施过程中的适用规则,建立适合我国化妆品行业发展的化妆品标准体系。

Objective:To systematically analyze the current status of cosmetic standards in China,to provide references for further strengthening the construction of the cosmetic standards system,and to explore the coordination of cosmetic standards with different implementation effectiveness in order to propose suggestion for the safe production,operation and supervision of cosmetics in China.Methods:Based on the definitions of cosmetics,the relationship between the existing regulations and standards and the relationship between different standards were analyzed,and the possible problems in the implementation of standards were analyzed as well.Results and Conclusion:Many problems were found such as the inconsistency of the existing cosmetic standards on the same matter and the incompleteness and inconsistency of the cosmetic standard system.It is recommended to carry out the carding work on cosmetics standards,revise conflicting and contradictory items about cosmetic standards,revise or abolish cosmetic standards that are no longer applicable and clarify the applicable rules for cosmetic standards in the implementation process so as to establish a cosmetic standard system adaptable for the development of China's cosmetic industry.
