我国当前刑事立法理念与技术评析——《刑法修正案(十一)(草案)》学术研讨会观点综述

An Analysis on Current Criminal Legislation Ideas and Techniques in China——Summary of the Views of the Symposium on the Amendment of Criminal Law(11)(Draft)

由四川省犯罪防控研究中心和中国法学会律师法学研究会共同主办的《中华人民共和国刑法修正案(十一)(草案)》(以下简称《草案》)理论研讨会,以"刑法修正中的基本理论探讨"和"草案中的具体个罪研究"划分议题,深入探讨了刑法的立场与价值取向、刑法修正中的司法因素、轻罪立法的体系性等刑事立法理论,同时聚焦于高空抛物行为、妨害驾驶公共交通工具行为、非法基因编辑行为和食品安全监管渎职等具体刑事立法热点问题展开了讨论,并对草案的完善提出了修改建议。

The“Criminal Law Amendment(11)”(Draft)theory seminar,co-sponsored by Sichuan Crime Prevention and Control Research Center and Lawyers Law Research Association of China Law Society,divides the topics by“the discussion of the basic theories in the revision of the criminal law”and“the research on the specific crimes in the draft”,and discusses the position and value orientation of criminal law,the judicial factors in criminal law amendment,the systematic legislation of misdemeanor and other criminal legislation theories.This paper focuses on discussing the issues of criminal legislation,such as throwing objects from high altitude,obstructing the driving of public transport,illegal gene editing,malfeasance of food safety supervision and other hot topics of criminal legislation,and gives some suggestions for the improvement of the draft.
