论我国民法典继承编遗赠制度的适用与细化

On the Application and Refinement of the System of Inheritanceand Legacy in China's Civil Code

与我国《继承法》相比,我国《民法典》“继承编”虽然规定了遗赠制度的基本内容且有所发展,但在实施后还可能会遇到一些新问题和新情况,主要涉及建立遗赠效力制度,完善附义务遗赠相关内容,进一步明确遗赠标的物的范围,适时解决遗赠接受与放弃效力规则与我国民间习惯相冲突的问题等,需要通过立法解释、司法解释、制定实施细则等适当的方式予以细化,使我国遗赠制度更加适应新时代人民群众财产权益法律保障的需要。

Compared with China's Inheritance Law,although the inheritance compilation of Civil Code of China has stipulated the basic contents of the legacy system and developed it,some new problems and situations may be encountered after its implementation.The problems are mainly related to establishing the system of validity of bequests,perfecting the relevant contents of bequests with obligations,further clarifying the scope of the subject matter of bequests,and timely solving the conflicts between the rules of acceptance and abandonment of legacies and the folk customs of China.It needs to be refined by appropriate ways such as legislative interpretation,judicial interpretation and the formulation of implementation rules,so as to make our legacy system better meet the needs of the legal protection of the property rights and interests of the people in the new era.
