从法治思维到公安执法思维进路的逻辑研究

习近平新时代中国特色社会主义思想提到了法治思维,这里的法治思维是中国共产党立足社会转型和中国特色社会主义进入新时代背景下提出的"法治"的科学解释。法治是一种制度、理念、形态和境界,其核心价值是公平正义,应当成为人们的信仰和生活方式。从逻辑学的角度来审视,习近平新时代中国特色社会主义思想所提到的法治,是治国理政的思维方式,而不是狭隘地由执法者对违法者进行惩罚。公安机关要学会科学解读法治思维对公安执法工作的指导,逐渐形成具有中国特色的执法思维,了解从法治思维到公安执法思维的逻辑进路,对公安执法思维下开展新时期的公安执法工作大有裨益。

In Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era,the rule-of-law thinking is referred to as a scientific explanation for"the rule of law"highlighted by the Communist Party of China against the background of China’s social transformation and the socialism with Chinese characteristics having entered a new era.The rule of law is a system,a concept,as well as a form and a level,whose core values,namely fairness and justice shall become people’s belief and lifestyle.From a logical point of view,the rule of law in Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era is a way of thinking for governance of the country,rather than a punishment for the lawbreakers by the law enforcers.The public security organs are obliged to scientifically comprehend the guidance of rule-of-law thinking on police’s law enforcement,gradually develop law enforcement thinking with Chinese characteristics,and understand the logical evolution path from rule-of-law thinking to police’s law enforcement thinking.These efforts will inevitably contribute to police’s law enforcement under the guidance of police’s law enforcement thinking in the new era.
