Substantive Structure of Legal Supervisory Authority

检察机关作为宪法规定的国家法律监督机关,是我国建设法治国家的重要保障。在监察体制改革导致检察院部分职能的整合、减少后,检察机关应借此契机回归到"国家法律监督机关"的宪法定位。新的法律监督机关的建设,必须深刻思考当前法律监督工作中应监督者不监督或无法监督,被监督者不服从或不认真对待监督的虚置现状,重新构造并细化法律监督规范体系,建立法律监督的专业化队伍,灵活使用强力、有效的法律监督手段,实质构造规范、专业的国家法律监督机关。

As the national legal supervisory authorities defined in the Constitution,the procuratorial organs are important guarantee for China to build a country ruled by law.After the reform of the supervisory system has resulted in the integration and reduction of some procuratorial functions,the procuratorial organs should take this opportunity to return to the position defined by the Constitution as the"national legal supervisory authorities".When constructing a new legal supervisory authority,we must reflect on the current status of legal supervision,such as the supervisors fail to perform supervisory duties or are unable to supervise,and the supervised parties disobey or neglect the supervision.It’s also imperative to reconstruct and refine the normative system of legal supervision,organize a professional team of legal supervision,flexibly use powerful and effective means of legal supervision,and construct a standardized,professional and powerful authority of legal supervision.
