关于完善《监狱法》中女犯改造工作规定的思考

Some Thoughts on Improving Stipulations on Women Prisoners’Rehabilitation in the Prison Law

女子监狱是关押女性犯罪人的专门场所,是监狱的一个特殊类型。《监狱法》中对女犯改造工作的规定零星、分散,缺少可操作性。女子监狱是否需要武装看押、未成年女犯应该关押在什么场所、女犯的隐私权以及特殊群体女犯的权益如何保障等问题亟待法律作出明确规定。在《监狱法》修订过程中,需要在深入调查研究的基础上,总结改造女犯的成功经验,注意与其他妇女法律的衔接,同时借鉴联合国制定的《曼谷规则》和国外女犯矫正立法经验。

Women’s prison is a special type of prison where women criminals are confined.In current Prison Law,the stipulations on women prisoners’rehabilitation are scarce,fragmentary and hard to be operated in practice.Many problems need to be explicitly stipulated by law,such as whether forced detention is necessary for a women’s prison,where to confine minor female criminals,how to protect women prisoners’privacy and the rights and interests of special groups of women prisoners.During the revision process for the Prison Law,there’s the necessity to sum up the successful experiences in women prisoners’rehabilitation based on an in-depth investigation and study,pay attention to the connections with other women-related laws,and use United Nations Rules for the Treatment of Women Prisoners and Non-custodial Measures for Women Offenders(the Bangkok Rules)and other countries’legislative experiences in women prisoners’correction for reference.
