摘要
《上海市生活垃圾管理条例》的颁布从立法层面昭示着生活垃圾由"倡导分类时代"迈向了"强制分类时代",该条例第52条规定了生活垃圾跨区域处置生态补偿相关法律问题,这是生活垃圾跨区域处置生态补偿首次在实定法中出现。从生态补偿制度整体的图景来看,生活垃圾跨区域处置生态补偿应当是生态补偿制度类型范围的拓展。对于新兴的生活垃圾跨区域处置生态补偿制度,就其制度设想而言,应当从生活垃圾跨区域处置生态补偿的补偿原理、补偿原则、补偿机制、补偿标准、补偿类型和补偿模式等内容进行具体的分析和探讨;就其保障机制而言,应当从依据保障、资金保障、安全保障和实施保障等方面健全相关机制。
The promulgation of the Regulation of Shanghai Household Garbage Management indicates the shift of household garbage classification from advocating to forced taxonomy.Article 52 stipulates the ecological compensation legal issues about cross-regional disposal of household garbage,the first one in real law.From the perspective of the overall picture of ecological compensation system,ecological compensation of cross-regional disposal of household garbage should be a new extension in this field.In terms of its system envision,it is essential to carry out specific analysis on the compensation principles,standard,mechanism and pattern.In terms of its safeguard mechanism,it should be improved from the safeguard of basis,fund,security and implementation.
